These Terms of Use (the “Terms”) are a legally binding agreement between you and
NoelTech Solutions LLC, doing business as TondiMatch (“TondiMatch,” “we,” “us,”
or “our”). They govern the TondiMatch mobile applications, related websites, and
dating, messaging, support, verification, subscription and safety features
(collectively, the “Service”).
The Privacy Notice and Community Rules
are part of these Terms. By creating an account, purchasing a subscription, or
selecting a control that states you agree, you confirm that you have read and
accept them. If you do not agree, do not use the Service.
These documents are published in English. The app is also offered in French.
Until a counsel-reviewed French legal text is published, this English version
governs, except where the mandatory law of your country requires otherwise.
You must be 18 or over and legally able to enter a binding contract.
One account per verified email address.
You may not use the Service if applicable law prohibits you from doing so, if
you are required to register as a sex offender, if you have been convicted of
human trafficking or a sexual offence, or if TondiMatch previously removed you
unless we give written permission.
You represent that your account information is accurate, you are using your own
identity, and your use complies with the laws that apply to you. We may request
information reasonably necessary to confirm age, identity, eligibility or
account integrity. We do not run a criminal background check on every user.
You may create an account using the sign-in methods TondiMatch makes available,
including an emailed code, Apple, or Google. Phone-number sign-in is built but
switched off. Keep access to your sign-in account and device secure. Do not
share, sell, transfer, or create an account for another person. Notify
support@tondimatch.com promptly if you suspect unauthorized access.
You are responsible for activity you knowingly authorize. TondiMatch may connect
accounts or devices when reasonably necessary to prevent fraud, enforce these
Terms, or protect users. We do not hold payment cards or Mobile Money numbers,
so we cannot “link payment methods.”
TondiMatch provides tools that help adults discover and communicate with other
users. TondiMatch does not arrange or supervise dates, guarantee a match or
relationship, verify every statement, perform a criminal background check on
every user, provide immigration or marriage-broker advice, or guarantee anyone's
identity, intentions, compatibility, conduct or safety.
Recommendations and safety systems may use automated processing and human
review. A profile, match, recommendation or verification badge is not an
endorsement. Verification means a moderator compared a live selfie to your
profile photos. It does not mean a person is honest, kind or safe.
We do not currently offer video profile media, voice notes on profiles, or in-app
voice or video calls. Any previously stored profile voice intro is deleted.
You decide whether and how to communicate or meet. Use reasonable caution: keep
early conversations on TondiMatch, do not send money or financial credentials,
protect your home and workplace details, meet first in a public place, tell a
trusted person, arrange your own transportation, and leave if you feel unsafe.
For immediate danger, contact local emergency services. TondiMatch is not an
emergency service. Report scams, threats, suspected minors, trafficking,
impersonation, harassment, sexual misconduct, non-consensual intimate imagery
and other violations with the in-product report tools or support@tondimatch.com.
Meeting anyone from the internet carries risk.
You must follow the Community Rules. Without limiting
those rules, you may not:
TondiMatch will never ask you to send money to a person, or to TondiMatch,
outside the official App Store or Google Play purchase sheet. Members must not
ask each other for money.
You retain ownership of content you submit. You represent that you have the
rights and permissions necessary to provide it and that it is not unlawfully
misleading. You grant TondiMatch a non-exclusive, worldwide, royalty-free,
sublicensable licence to host, store, reproduce, format, display, transmit,
moderate and distribute your content only as reasonably necessary to operate,
secure and improve the Service in accordance with the feature and your
settings. This licence does not include a right to use your photos or profile
in paid advertising.
The licence ends when the content is deleted from active systems, except for
copies retained in backups, already shared with other users, preserved for
safety or legal reasons, or necessary to establish, exercise or defend claims.
Do not post information that you do not want other users to see.
The Service, software, design, branding and TondiMatch-created content belong to
TondiMatch or its licensors. We grant you a limited, personal, revocable,
non-transferable licence to use the Service for lawful personal dating and
social discovery. You receive no right to copy, sell, scrape, publicly display,
commercially exploit, or create derivative services from TondiMatch materials.
Profiles and photos are checked automatically where we can, and may appear as
soon as you save them. Content that our filters flag is held for a person to
review. We also review after publication when members report something, and we
remove what breaks these rules. We act on reports. A person reads them.
We may investigate, preserve, restrict, remove, warn, suspend, terminate or
report content or conduct when we reasonably believe it violates these Terms or
the Community Rules, presents risk, or requires action under law. Urgent
protective action may occur before a final determination.
You can appeal any decision, including a permanent removal, by writing to
support@tondimatch.com. There is no appeal form in the app today; email is the
route, and a suspended account can still sign in to send it. Moderation
mistakes happen and an appeal is the only check on them. We may limit details
that could endanger someone, compromise detection systems, disclose
confidential information, or violate law.
TondiMatch is free to use. Optional paid features are sold only through the
App Store (iOS) or Google Play (Android):
allowance from one to five, lets you see which members have liked you (everyone
can see how many; Premium shows who), and removes the daily limit on taking back
your last swipe. We do not sell Super Like packs, and we do not sell a way past
the daily like cap — the number of ordinary likes is the same whether or not you
subscribe. Spotlight is a separate purchase, not part of Premium.
Like allowance from one to three and the daily limit on taking back your last
swipe from one to five. It does not show you who liked you — that stays with
Premium — and everything else Plus changes, Premium also includes. Buying
Premium while subscribed to Plus upgrades you through the store; the store
handles any price difference.
lifts you higher in other members' Discover for a limited window. A placement
normally lasts thirty minutes, unless the store states a different length for
the product you bought. Placements extend the same window rather than running
side by side. You can hold at most two hours of placement at a time, and we
credit at most four placements per day, measured in UTC. The app stops
offering a purchase once either limit is reached; if a charge still reaches
us beyond those limits, it adds no further time, and you should request a
refund from Apple or Google, who took the payment. Spotlight changes where
you appear. It never changes who you see, and it cannot show you to someone
who blocked you or whose filters exclude you.
We never collect cards, Mobile Money numbers, PINs, or wallet details — the
phone opens the store’s own payment sheet, and Apple or Google take the money.
Safety stays free. Blocking, reporting, verification, the Safety Center and
Safe Date Plan are never paywalled.
A subscription may renew automatically until cancelled. The purchase screen will
state the price, currency, billing period, renewal terms, trial or promotional
conversion, cancellation method, and any material restrictions before you
authorize payment. Purchases through Apple or Google are billed and managed by
that store, and the store's payment and refund rules also apply. Deleting the
app or your TondiMatch account does not automatically cancel a store
subscription. Cancel the subscription through the store before renewal.
If we permanently discontinue a prepaid feature, we will provide the remedy
required by applicable law.
We may send service, safety, security, purchase, account, match, like or message
notices through the app, email or push notification as permitted by law and your
settings. We do not currently send SMS or marketing campaigns. If we start
marketing, we will obtain any consent required by law and include an opt-out. A
notice stating that you received a like, match or message will be based on a
genuine qualifying event when sent, subject to moderation and account status.
The Privacy Notice explains how we handle personal
information. Dating information can reveal sexual orientation, religion,
ethnicity, sex life, health-related preferences and location. Do not provide
another person's sensitive information unless you have authority.
You may request deletion at any time from Profile → Your data and account.
Deleting the app does not delete your account. After you request deletion we
wait 7 days, during which you may cancel the request, then erase or
de-identify information as described in the Privacy Notice, subject to safety,
fraud, payment, legal, dispute and backup exceptions.
We may suspend or terminate access for violations, risk, inactivity, legal
requirements or discontinuation, subject to appeal.
We respond to valid copyright notices and may terminate repeat infringers. Send
notices to NoelTech Solutions LLC, 209 Nassau Street, St. Peter, MN 56082,
United States, and support@tondimatch.com. Include: your signature; identification
of the work; identification of the material and where it appears; your contact
information; a statement of good-faith belief that the use is not authorized;
and a statement under penalty of perjury that the notice is accurate and that
you are the owner or authorized to act.
If we remove something of yours in response to a copyright notice, you may send
a counter-notice to the same address. Include: your signature; identification of
the material removed and where it appeared; a statement under penalty of perjury
that you believe in good faith it was removed by mistake or misidentification;
your name, address and telephone number; and your consent to the jurisdiction of
a court where you live, or of Nicollet County, Minnesota if you live outside the
United States. Where the law provides for it, we may restore the material unless
the original complainant files suit.
Knowingly false or abusive reports, and knowingly false counter-notices, may
violate these Terms and applicable law.
We may change features, country availability or pricing. We will provide notice
and seek consent where applicable law requires it. We do not guarantee that the
Service will always be uninterrupted, secure or error-free, or that every
feature will remain available in every country or on every device.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND
“AS AVAILABLE.” TONDIMATCH DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT
ANY USER'S IDENTITY, BACKGROUND, STATEMENTS, INTENTIONS, COMPATIBILITY, CONDUCT
OR SAFETY; THAT A MATCH OR RELATIONSHIP WILL RESULT; OR THAT EVERY HARMFUL USER,
MESSAGE OR ACT WILL BE DETECTED OR PREVENTED.
Nothing in these Terms excludes a warranty, duty or remedy that applicable law
does not allow us to exclude.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TONDIMATCH AND ITS AFFILIATES, OFFICERS,
EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA,
GOODWILL OR OPPORTUNITY, ARISING FROM THE SERVICE OR USER INTERACTIONS, EVEN IF
ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS
RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU
PAID FOR THE SERVICE, TO APPLE, GOOGLE OR TONDIMATCH, IN THE TWELVE MONTHS
BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) US$100. MOST MEMBERS PAY
NOTHING, AND WHERE YOU PAID A STORE RATHER THAN US, THAT AMOUNT STILL COUNTS
TOWARD LIMB (A). THIS LIMIT DOES NOT APPLY TO
LIABILITY THAT CANNOT LAWFULLY BE LIMITED, WHICH MAY INCLUDE FRAUD, WILLFUL
MISCONDUCT, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR
VIOLATION OF NON-WAIVABLE PRIVACY OR CONSUMER RIGHTS.
TondiMatch introduces adults to each other. It does not supervise what they
then say or do. To the maximum extent permitted by law, and except where our
own negligence, willful misconduct or breach caused it, you release TondiMatch
from claims, demands and damages arising out of a dispute with another member,
including anything said, sent, promised or done during or after a meeting
arranged through the Service.
This release does not limit any right you cannot lawfully waive, does not
affect claims against the other person, and does not apply where the law of
your country says otherwise. Nothing here discourages you from reporting a
crime to the police, or from reporting the member to us.
To the extent permitted by law, you will defend and indemnify TondiMatch against
third-party claims arising from your unlawful conduct, your content, your
material breach of these Terms, or your violation of another person's rights.
This obligation does not require you to indemnify TondiMatch for our own
negligence, willful misconduct, unlawful processing or breach. We may control
the defense and will reasonably cooperate.
Before starting arbitration or litigation, the claimant must send an
individualized notice to support@tondimatch.com and 209 Nassau Street, St. Peter,
MN 56082, United States. The notice must identify the account, relevant facts,
requested relief and claimant's signature. The parties will try in good faith to
resolve the dispute for 60 days. Applicable limitation periods are tolled during
that period.
This section applies only to U.S. residents and only where lawful. It does not
require a Cameroon resident, or any other non-U.S. resident, to arbitrate in the
United States.
Except for eligible small-claims cases, urgent protective relief,
intellectual-property misuse, regulator complaints, and matters that
non-waivable law allows in court, disputes with U.S. residents will be resolved
by individual binding arbitration administered by the American Arbitration
Association (AAA) under the AAA Consumer Arbitration Rules then in effect.
Rules and filing information are available at https://www.adr.org/consumer. If
AAA is unavailable or declines administration, the parties will select another
nationally recognized consumer-arbitration provider; if they cannot agree, a
court may appoint one. TondiMatch will pay fees as required by the rules or
applicable law.
Claims must proceed individually, not as a class, collective, consolidated,
coordinated or representative action, to the extent lawful. If part of this
waiver is finally held unenforceable for a claim or remedy, that part will
proceed in court after arbitrable issues are completed.
You may opt out of arbitration by emailing support@tondimatch.com within 30 days
after first accepting these Terms. Include your name, account email or
identifier, and a clear statement that you opt out of arbitration. Opting out
will not affect your account.
For U.S. residents, Minnesota law governs, without regard to conflict-of-law
principles, except for arbitrable disputes and where mandatory law requires
otherwise. The state or federal courts serving Nicollet County, Minnesota have
exclusive jurisdiction over non-arbitrable disputes with U.S. residents.
If you live outside the United States, including in Cameroon, the mandatory law
and courts of your habitual residence may apply, and these Terms do not remove
non-waivable consumer, privacy or other protections. A Cameroon court or
regulator is not required to apply Minnesota law where Cameroon law does not
allow that result.
If you use the iOS app, Apple Inc. and its subsidiaries are third-party
beneficiaries of these Terms as they relate to your use of the app, and may
enforce them against you. Apple is not responsible for the Service, for
maintenance or support, or for addressing claims relating to the app. The same
principle applies to Google LLC for the Android app, to the extent Google's
terms require it. Your purchase contract for a subscription is with Apple or
Google, not with TondiMatch, except where the law says otherwise.
These Terms and the incorporated policies are the complete agreement about the
Service. An unenforceable provision will be narrowed or severed without
affecting the remainder. Failure to enforce is not a waiver. You may not assign
your account. We may assign these Terms in a merger, financing, reorganization
or sale, with notice where required.
We may update these Terms and will post the revised version and date. The
version you accepted is recorded when you create an account. We do not currently
block existing accounts until they re-accept a later version.
Instead, a revision takes effect for an existing account like this. For a change
that materially affects your rights or obligations, we will give notice in the
app or by email where we have an address, at least 30 days before it takes
effect, and the change applies to you if you keep using the Service after that
date. Other changes take effect when posted. If you do not accept a change, stop
using the Service and delete your account before the change takes effect — that
is your remedy, and it is always available from **Profile → Your data and
account**. Where the law requires your express agreement to a particular change,
we will ask for it rather than rely on continued use.
A revision will not retroactively change a formally asserted dispute unless both
parties agree.
